Diagnosed with Cancer After Using Monsanto’s Roundup Weed Killer?
One of the biggest product liability scandals in recent years involves the world’s most popular herbicide, Roundup weed killer. Roundup, manufactured and distributed by Monsanto (later acquired by Bayer), was used for decades by commercial farmers, landscapers, and personal gardeners alike. Over the last decade, scientific evidence has come to light linking Roundup to several forms of debilitating, and often fatal, cancer. Bayer has faced a number of individual and class action lawsuits as a result of its dangerous products, and it continues to face new liabilities as more injured victims emerge.
If you have contracted lymphoma, leukemia, or other forms of cancer after prolonged use of Roundup weed killer, or if you have a loved one who has succumbed to cancer following exposure to the product, please contact the Morris Law Firm. You could be eligible for substantial compensation for the medical bills, pain and suffering, and emotional distress caused by your condition and the devastation that you and your family have suffered.
The Dangers of Roundup Weed Killer
Roundup is an herbicide commonly used in private gardens and for commercial purposes. Roundup’s key herbicide ingredient is called glyphosate. Over the last decade, evidence has emerged demonstrating that glyphosate exposure significantly increases the likelihood of a person contracting several forms of cancer including leukemia, multiple myeloma, and non-Hodgkin lymphoma.
While scientists had suspected a link between glyphosate and cancer for some time, in 2015 the World Health Organization officially declared that glyphosate is likely carcinogenic for humans. The declaration gave rise to several lawsuits, although Bayer/Monsanto continues to deny the link.
Who Can Bring a Roundup Cancer Claim?
In order to file a product liability claim, a plaintiff must establish that the defendant manufactures and/or distributes a defective product, that the plaintiff suffered an illness or injury, and that the plaintiff’s injury was caused by the product’s defect. For claims against Monsanto/Bayer, that means proving that you were exposed to Roundup in sufficient quantities and that you are suffering from a condition known to be caused by Roundup’s active ingredient, such as leukemia, non-Hodgkin lymphoma, or multiple myeloma.
We now know that Roundup drastically increases the likelihood of contracting various forms of cancer. To bring a claim, the plaintiff must show that they suffer from one of those forms of cancer and that they were exposed to sufficient quantities of Roundup to cause the condition. While anyone can bring a lawsuit, and Roundup is often used by private gardeners tending their home gardens, people who work in certain professions are more likely to have prolonged exposure to the dangerous product. These professions include landscaping, gardening, groundskeeping, soil science, commercial farming, and surveying.
If you or someone you love has been exposed to Roundup and has subsequently been diagnosed with cancer, talk to a California Roundup cancer lawyer as soon as possible to discuss your claims.
If You Have Cancer, You Can Still Sue Bayer/Monsanto Today
Bayer has faced thousands of lawsuits as a result of the carcinogenic nature of its glyphosate-based products. Bayer has settled a number of claims to the tune of more than $11 billion, covering many eligibility plaintiffs. As of March 2022, however, there are over 4,000 cases still remaining in the Roundup multidistrict litigation.
If you have grounds for a claim against Bayer–if you or someone you love has suffered from cancer following exposure to Roundup at work or home–you still have the right to bring a claim. Plaintiffs who are newly diagnosed are not bound by prior settlements, nor are any victims who opted not to join the prior settlement.
If you believe you or someone you care about may have a claim based on Roundup cancer, speak with a knowledgeable product liability and toxic tort attorney today. The sooner you act, the sooner you can learn whether you may have a claim for damages and what steps you need to take to preserve your right to collect the compensation you and your family are owed.
